General terms and conditions of sale

1 – Scope of application

All our sales are governed by these general terms and conditions of sale, which take precedence over any conditions and terms of purchase unless expressly stipulated otherwise. By placing an order, you agree to these terms and conditions of sale in their entirety.

2 – Prices, terms of payment and penalties

The applicable prices are those in force on the day the order is received and confirmed and appear on the price list opposite, stated in euros. They are “ex-cellar” prices with the cost of transport being the responsibility of the purchaser. Unless otherwise agreed between the parties, payment shall be due at the time the order is placed. If a payment term is agreed, no discount will be granted for early settlement.

Any payment received after the due date stated on the invoice will result in the application of late payment penalties equal to three times the legal interest rate under Article L 441-6 of the french commercial code. These penalties are payable without the seller having to issue any formal notice. In addition, all collection costs will be borne by the purchaser.

In application of the legal provisions, any business customer that is late in paying an invoice will owe the creditor a fixed compensation fee of €40 for collection costs. However, if the collection costs are higher than the amount of this compensation fee, the creditor may request additional compensation, upon presentation of proof.

3 – Right of withdrawal

If the purchaser is a business: there is no right of withdrawal.

If the purchaser is a private individual: in the case of a sale concluded remotely or not on the seller’s premises, the purchaser has a period of 14 days from the date the wines are received to cancel the purchase. The purchaser can use the example withdrawal form provided below. The seller will then reimburse all the payments received to the purchaser, upon receipt of the returned goods. The seller will issue the refund using the same method of payment as that used by the purchaser for the initial transaction unless a different method is agreed. In any event, this refund will not incur any costs to the purchaser. If at the time of withdrawal the purchaser has already received the bottles, he must return them to the seller’s address without undue delay and no later than 14 days after his notification of withdrawal. This period is deemed to have been respected if the goods are re-despatched before the expiry of the 14-day period. The direct costs of returning the goods shall be borne by the purchaser. These costs will depend on the quantity of wine ordered.

The purchaser may be held liable for any deterioration of the goods resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the goods.

The purchaser has no right of withdrawal if the sale has been concluded at a fair or a show.

4 – Delivery

This is carried out either by direct delivery of the goods to the purchaser or to the place indicated by the purchaser on the order form. Our wines are transported at the consignee’s own risks, even in the case of franco delivery. The seller cannot be held liable for damage, loss, theft or defective packages. Consequently, purchasers are invited to check the packages on receipt and to notify the carrier of any reservations by registered letter within 3 working days of receipt of the goods.

5 – Retention of title

The seller retains ownership of the goods sold until full payment of the invoice by the purchaser. However, upon delivery, the risks of loss or deterioration are transferred to the purchaser.

7 – Litiges

Our sales are subject to French legislation. The Tribunal de Grande Instance in Reims is specifically assigned jurisdiction in this respect.

Only the documents written in French have contractual value and are valid between the parties. In the event of any inconsistency between this English translation and the original French version of this document, the French version shall have precedence.
